Section 14
Submit in writing to the Central Authority Submit in writing to the Central Authority Details to be disclosed or documents to be attached

(1) When writing to the central authority for mutual legal assistance in accordance with section 7, 8, 9, 10, 11, 12 or 13, the concerned authority or the court shall disclose the following details:
(a) Courts seeking judicial proceedings, summary proceedings and related laws,
(b) subject to mutual legal assistance requested,
(c) If the judicial action is of a criminal nature, the maximum sentence that can be imposed in that action and if it is of a civil nature, the maximum penalty for which the claim is made,
(d) the location and nature of documents, evidence, information, goods or property related to judicial proceedings,
(e) details of the item and the full address of such place, if required to be searched,
(f) In relation to a person who can assist in judicial proceedings, his/her name, address and nationality, including passport or female identity card number that can be identified, and other necessary details and as far as possible information regarding the place of residence,
(g) Confirmation that the requested document, evidence, information, object or person has a material relationship for the purpose of judicial proceedings,
(h) Confirmation of relevant documents in full copy if required and assurance that they will be returned if required,
(i) the relevant authorities of the foreign country requested to provide mutual legal assistance,
(j) Period during which mutual legal assistance must be provided,
(k) If an item is sent in writing to be searched or confiscated, the basis for confirming that the person who owns such item has committed an offense in Nepal or that the property has increased due to such offense,
(l) If a deadline or a judicial document has been requested to be served-
(1) The full name of the person on whom the term or judicial document is to be served,
(2) The country of residence of the person referred to in sub-section (1), the details of the passport or national identity card number, the identity of the person and other necessary details including nationality and as far as possible the place of residence.Bond information, (3) If the deadline or judicial document cannot be delivered to the address of the person as per sub-section (2), the country and address of the establishment where he works or conducts business.
(d) If the evidence is requested to be understood-
(1) Details of the court or body, if the court or body to which the evidence is requested can be identified,
(2) A description of the evidence to be taken or other judicial work to be done,
(3) If a witness is to be identified, the name, surname, nationality of such witness and details of the passport or national identity card that can reveal his identity,
(4) Details of the questions to be asked if the witness is to be understood by closed questions,
(5) Details of whether or not an oath should be taken when testifying,
(6) Details of any document, movable or immovable property, inspection, survey, measurement, map or test.
(d) If the asset is demanded to be confiscated or withheld-
(1) Details of whether judicial action is being filed, filed or not yet decided on property-related matters,
(2) A description of the nature of the seizure of property in the judicial proceedings,
(3) Statement that there is a confiscation order and there is no appeal on it,
(4) Details of the outstanding amount to be paid in accordance with the confiscation order,
(5) If the person affected by the order of confiscation is not present in the court, the statement that he has received notice with sufficient time for his defense.
(n) Other necessary details.
(2) The following documents should be attached when requesting details according to sub-section (1):-
(a) to present a person, to locate him or to send him for identification, as far as possible, his photograph,
(b) Evidence that the person requested to appear has expressed his desire to appear independently,
(c) an order passed by the Court in that regard,
(d) If a term or judicial document is to be served, two copies of the official copy of the term or judicial document to be served,
(e) If the judgment is sent for execution-
(1) A certified true copy of the judgment of the court,
(2) Re the matter of judgmentEvidence of not being able to apply.
